1. agreement to terms

Welcome to MatchPod! These Terms and Conditions ("Terms") govern your access to and use of the MatchPod mobile application (the "App"), operated by MatchPod ("we," "us," or "our").

By downloading, installing, or using MatchPod, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

We may update these Terms from time to time. We will notify you of any material changes by updating the "Last Updated" date and, where appropriate, providing notice through the App. Your continued use of MatchPod after any changes constitutes your acceptance of the new Terms.

Beta Service Notice: MatchPod is currently in beta. During the beta period, some features may be incomplete or subject to change. The App is provided free of charge during beta, with no payments processed and no advertisements displayed. We appreciate your feedback as we continue to improve the App.

2. eligibility

Age Requirement: You must be at least 18 years old to create an account and use MatchPod. By using the App, you represent and warrant that you are 18 years of age or older.

To use MatchPod, you must:

  • Be at least 18 years of age
  • Be legally capable of entering into a binding contract
  • Not be prohibited from using the App under applicable laws
  • Not have been previously banned or removed from MatchPod
  • Provide accurate and truthful information during registration

If we discover or have reason to believe that you do not meet these eligibility requirements, we reserve the right to suspend or terminate your account immediately without notice.

3. account registration & responsibility

3.1 account creation

To use MatchPod, you must create an account by providing your phone number and completing the verification process via OTP (One-Time Password). You agree to provide accurate, current, and complete information during the registration process.

3.2 account security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that your phone number remains secure and accessible only to you
  • Immediately notifying us of any unauthorized access or security breach

3.3 one account per person

Each user may only have one active MatchPod account. Creating multiple accounts is prohibited and may result in termination of all associated accounts.

3.4 account information

You agree to keep your profile information accurate and up-to-date. Misrepresenting your identity, age, or other personal information is a violation of these Terms.

4. app purpose & services

MatchPod is a roommate matching platform designed to help users find compatible roommates. The App provides:

  • Profile Creation: Tools to create and manage your roommate profile
  • Matching: Algorithm-based matching with potential roommates based on preferences and compatibility
  • Messaging: In-app communication between matched users

Important: MatchPod is a roommate matching service only. We do not provide room listings, property management, rental agreements, or any real estate services. Any arrangements made between users are solely between those users.

5. acceptable use

When using MatchPod, you agree to use the App responsibly and in accordance with these Terms. You agree to:

  • Use the App only for its intended purpose of finding roommates
  • Treat other users with respect and courtesy
  • Provide honest and accurate information in your profile
  • Communicate respectfully with other users
  • Report any suspicious or inappropriate behavior
  • Comply with all applicable laws and regulations

6. prohibited behavior

The following actions are strictly prohibited on MatchPod. Engaging in any of these activities may result in immediate account suspension or termination:

6.1 harmful content & behavior

  • Harassment, bullying, intimidation, or threatening behavior
  • Hate speech or discrimination based on race, religion, gender, sexual orientation, disability, or any other characteristic
  • Posting violent, abusive, or sexually explicit content
  • Stalking or unwanted contact with other users
  • Impersonating another person or entity

6.2 fraudulent activities

  • Creating fake profiles or providing false information
  • Using the App for scams, fraud, or deceptive practices
  • Soliciting money or financial information from other users
  • Posting misleading or false content

6.3 illegal activities

  • Using the App for any illegal purpose
  • Promoting or facilitating illegal activities
  • Sharing content that violates any law or regulation

6.4 technical violations

  • Attempting to hack, disrupt, or compromise the App's security
  • Using bots, scrapers, or automated tools to access the App
  • Reverse engineering or attempting to extract source code
  • Interfering with the proper functioning of the App
  • Circumventing any security measures or access restrictions

6.5 commercial misuse

  • Using the App for commercial advertising or solicitation
  • Promoting products, services, or businesses
  • Spamming other users with promotional content
  • Collecting user data for commercial purposes

7. user content

7.1 your content

"User Content" refers to any content you create, upload, or share on MatchPod, including but not limited to profile information, photos, and messages.

7.2 ownership

You own your content. You retain full ownership of all User Content you create and upload to MatchPod. We do not claim ownership of your photos, messages, or any other content you provide.

7.3 license to matchpod

By uploading content to MatchPod, you grant us a limited, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purpose of operating and providing the App's services. This license ends when you delete your content or account.

7.4 content guidelines

All User Content must:

  • Be your own original content or content you have rights to share
  • Not infringe on any third-party intellectual property rights
  • Not contain any prohibited content as outlined in Section 6
  • Be appropriate for a general audience

7.5 content removal

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or inappropriate.

8. interactions with other users

8.1 user responsibility

You are solely responsible for your interactions with other MatchPod users. We do not conduct background checks on users, and we cannot guarantee the accuracy of information provided by users.

8.2 safety recommendations

For your safety, we recommend:

  • Meeting potential roommates in public places first
  • Informing friends or family about your meetings
  • Trusting your instincts — if something feels wrong, it probably is
  • Verifying information provided by other users independently
  • Not sharing sensitive personal or financial information

8.3 no liability for user actions

MatchPod is not responsible for the conduct of any user, whether online or offline. We are not liable for any damages arising from your interactions with other users.

9. account suspension & termination

9.1 termination by you

You may terminate your account at any time by requesting account deletion through the App or by contacting us at support@matchpod.in.

9.2 termination by us

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Engaging in prohibited behavior
  • Receiving multiple reports from other users
  • Suspected fraudulent or illegal activity
  • Extended period of inactivity
  • Any conduct we deem harmful to the MatchPod community

9.3 effects of termination

Upon termination of your account:

  • Your access to MatchPod will be immediately revoked
  • Your profile will no longer be visible to other users
  • Your User Content may be deleted
  • Active matches and conversations will be terminated

9.4 appeal process

If you believe your account was suspended or terminated in error, you may contact us at support@matchpod.in to request a review. We will consider appeals on a case-by-case basis.

10. intellectual property

10.1 matchpod property

The MatchPod App, including its design, features, functionality, branding, logos, and all related intellectual property, is owned by MatchPod and protected by copyright, trademark, and other intellectual property laws.

10.2 limited license

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

10.3 restrictions

You may not:

  • Copy, modify, or distribute the App or its content
  • Use our trademarks, logos, or branding without permission
  • Remove any copyright or proprietary notices
  • Create derivative works based on the App

11. disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any matches or connections will lead to successful roommate arrangements
  • The App will meet your specific requirements

MatchPod is a platform to facilitate connections between users. We do not guarantee the quality, safety, or legality of any roommate arrangements made through the App.

12. limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATCHPOD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

This includes, but is not limited to:

  • Any damages arising from interactions with other users
  • Any loss of data, profits, or business opportunities
  • Any damages resulting from unauthorized access to your account
  • Any damages arising from roommate arrangements made through the App
  • Any physical, emotional, or financial harm resulting from meetings with other users

In no event shall our total liability exceed the amount you paid to MatchPod (if any) in the twelve (12) months preceding the claim.

13. indemnification

You agree to indemnify, defend, and hold harmless MatchPod, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your User Content
  • Your interactions with other users

14. dispute resolution

14.1 informal resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@matchpod.in to attempt to resolve the dispute informally. We will work with you in good faith to resolve any issues.

14.2 arbitration

If we cannot resolve the dispute informally, any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.

15. governing law

These Terms and Conditions are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any legal proceedings arising from or related to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.

You agree to comply with all applicable local, state, and national laws and regulations when using MatchPod.

16. general provisions

16.1 entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MatchPod regarding your use of the App.

16.2 severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

16.4 assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights under these Terms without restriction.

16.5 no agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and MatchPod.
